Terms of Service

FenceSitter is a subscription platform for fence installation companies that helps identify recoverable sales opportunities and automate lead follow-up by email and text. We may add, change, or remove features over time. We aim for high availability but do not guarantee the service will be uninterrupted or error-free.

You must provide accurate information and keep your login credentials secure. You are responsible for activity under your account and for your team members' use of the service. Notify us promptly of any unauthorized use. Accounts are for business use by the company that registered them.

FenceSitter is sold as a monthly or annual subscription and may include a one-time setup fee. The checkout screen shows the exact amounts, billing interval, and start date before you confirm. Subscriptions renew automatically for the same interval until canceled.

Payments are processed by Stripe. Fees are charged in advance and, except where required by law, are non-refundable. We may change pricing for a future renewal term with at least 30 days' notice. Taxes are your responsibility where applicable. Failed or overdue payments may result in suspension.

Until payment processing is enabled on your account, access may be provided without charge on a trial or preview basis, which we may end or convert to a paid plan with notice.

You can cancel at any time from the billing page. Cancellation takes effect at the end of the current paid term and stops future charges; fees already paid are not refunded. After a subscription ends, your data is retained in a restricted state so you can resubscribe, and is deleted on request or per our Privacy Policy. We may suspend or terminate an account for material breach of these Terms, illegal use, or non-payment.

As between you and FenceSitter, you own the lead, customer, and conversation data you import or generate (“Customer Data”). You grant us a limited license to host, process, and transmit Customer Data solely to provide and support the service. Our handling of personal information is described in the Privacy Policy.

You agree that you will:

• have a lawful basis and any required consent to contact the leads and customers you import;
• comply with all laws that apply to your messaging, including the CAN- SPAM Act, the Telephone Consumer Protection Act, applicable state texting and auto-dialer rules, and carrier requirements;
• honor opt-out and unsubscribe requests promptly — FenceSitter provides automatic opt-out handling, but you remain responsible for your campaigns;
• not use the service to send unlawful, deceptive, harassing, or unsolicited bulk messages, to infringe others' rights, or to probe or disrupt the service's security.

You are responsible for the content of messages sent from your account, including AI-assisted drafts you choose to send.

FenceSitter uses AI to categorize opportunities, estimate reactivation likelihood, and draft messages. AI output can be wrong or incomplete and is provided for your review. Do not rely on it as legal, financial, or professional advice, and check any facts, pricing, availability, or commitments before sending. You control what your AI settings permit and whether messages send automatically or after human approval.

If you connect a mailbox, CRM, or other third-party service, your use of that service is governed by its own terms, and you authorize FenceSitter to access it as needed to provide the integration. We are not responsible for third-party services or for data loss caused by them.

FenceSitter and its software, design, and content are owned by us and our licensors. We grant you a limited, non-exclusive, non-transferable right to use the service during your subscription. You may not copy, modify, resell, reverse-engineer, or create derivative works of the service. Feedback you provide may be used by us without obligation.

FenceSitter does not guarantee any particular amount of recovered revenue, number of reactivated leads, or business outcome. Figures shown in the product are estimates based on your data.

The service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

To the fullest extent permitted by law, FenceSitter will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the service will not exceed the amount you paid to FenceSitter in the 12 months before the event giving rise to the claim.

You will defend and indemnify FenceSitter against claims, damages, and costs arising from your Customer Data, your messaging, or your breach of these Terms or of applicable law.

We may update these Terms. We will post the revised version here with a new date and, for material changes, give notice through the app or by email. Continued use after changes take effect means you accept them.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware have exclusive jurisdiction over disputes not subject to another agreed process, and you consent to venue there.
